1. Acceptance of Terms
By accessing or using AI Interviewer ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. The Service is operated by AI Interviewer ("we," "us," or "our").
2. Description of Service
AI Interviewer is a SaaS platform that provides AI-powered structured interviews for research, feedback collection, and data extraction. The Service includes survey creation, AI-conducted interviews, data analysis, embeddable widgets, and API access (where applicable to your plan).
3. Account Registration
You must provide accurate, complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized use.
4. Subscription Plans and Billing
The Service offers Free, Pro, and Enterprise plans. Paid plans are billed monthly. You may upgrade or downgrade at any time; changes take effect on your next billing cycle. We reserve the right to modify pricing with 30 days' notice. Refunds are handled on a case-by-case basis.
5. Acceptable Use
You agree not to: (a) use the Service for illegal purposes; (b) attempt to gain unauthorized access to our systems; (c) transmit malware or harmful code; (d) use the Service to harass, abuse, or harm others; (e) conduct interviews that deceive respondents about the nature of data collection; (f) exceed your plan's usage limits through automated means.
6. Data Ownership
You retain ownership of all data you submit to or collect through the Service, including survey configurations, interview transcripts, and analysis results. We do not claim ownership of your data. We may use anonymized, aggregated data to improve the Service.
7. Data Processing
Interview data is processed by third-party AI providers (currently Anthropic) to conduct interviews and generate analysis. By using the Service, you consent to this processing. We select AI providers that maintain appropriate data handling practices. See our Privacy Policy for details.
8. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted service. We may perform maintenance with reasonable notice. We are not liable for downtime, data loss, or service interruptions beyond our reasonable control.
9. Intellectual Property
The Service, including its software, design, and documentation, is owned by us and protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.
10. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or data, arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
11. Termination
You may cancel your account at any time. We may suspend or terminate your account for violation of these Terms. Upon termination, your right to use the Service ceases. We will retain your data for 30 days after termination, after which it may be deleted.
12. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email or in-app notification. Continued use after changes constitutes acceptance.
